…have a clause in their CC&Rs (the documents that govern such communities) that allow them to enforce at any time and state specifically that failure to enforce does not give up the right to enforce. There is case law all the way to the CA state Supreme Court upholding the right of Associations to have all kinds of restrictions and the 55+ is one that is anchored in Federal law. Just because they have not done anything does not mean they cannot, but it also does not mean they will.

My elderly parents inherited a mobile home in a co-op resident owned park in CA. They have allowed me to stay in the home until I get back on my feet job-wise (I’m obviously under the age limit). Both the park manager and residents association leader have seen me leaving the park on several occasions and have said nothing about it, but I’m suspecting they will eventually. I’ve been here for 3 months.
I’ve read about unauthorized tenant loopholes where if I’ve been living there in plain-view of the managers for 3 months they have inadvertently accepted my residency in the park and we can’t be evicted, is this true for senior co-ops?
For the record I haven’t been a nuisance or rowdy, and don’t even use the park facilities. I wonder if they put 2 and 2 together that I live here.
I do provide some care and errands for my parents but they are not so bad off where they need a live-in helper.

Every Sr MHP has to live by the Jr.-to-Sr. ratio allowed in that state, and if the allowable % was exceeded, by too many Jrs they could lose their Sr MHP status.
I’ve seen this happen in a number of Sr MHPs in WA, and even watched a couple of them lose their Sr status because they allowed the “allowable percentage” to rise when the number of Jrs. exceeded that percentage.
So having one or two youngsters there isn’t going to alarm the MHP, but at some point they’ll have to act or lose their Sr MHP status and they’ll have Srs wanting to move out, Srs electing to live elsewhere, etc…a royal mess that they surely do not want.
