What kind of partnership did you form? What kinds of agreements were signed? This will tell you whether or not your partner is on the hook. You may have to sue him anyway, since he bailed.
What does the sales contract say about earnest money deposit? Did both you and your partner sign the sales agreement? Does it have a clause anywhere in it stating that you, as the sellers, have joint and several responsibility? If it does it means you personally can be sued for the entire amount of the deposit if they cannot locate your partner. If it does not, then you would only be responsible for your half.
The deposit should have gone into escrow and not your bank accounts - this may be illegal in your state and the buyer may be able to file criminal charges as well. You have no business keeping a deposit unless you have fulfilled the contract. You did not. Since your partner bailed, then in order for you to not break the deal with buyer/seller, you needed to buy the house and resell it. You did not do that. Neither the buyer or seller has any interest in your side deal with a partner who is supposed to actually provide the funds to buy the property, so to them the fact your partner bailed is not relevant.

I’m looking for opinions on a deal gone bad and who should pay who.
A former partner and I were going to buy and sell a home with a 15 year note to new buyer. My partner was to front the money for the home.

Seller was ready sell the home and signed a contract us.

Buyer wanted to buy the home and gave deposit. Partner and I split the deposit 50/50.

Partner bailed. Did not purchase home.

Fast forward 6 months, (today)

Seller has since sold the home.

Buyer wants deposit money back.
My question:
Do I owe my half of the deposit back to the buyer?
OR
Should former partner pay all of deposit back to buyer in full?
After all, former partner broke deal with me, buyer and seller.

You make some very valid points. Our sales contract was basic. No mention of joint responsibilities. I did not know the deposit should have gone into escrow first.
As a note; I just learned this week from the buyers that the deal fell through. I am more than willing to refund their deposit money, in fact I have already talked to them and set up a time to do so. I just wanted to know if I could hold my former partner legally responsible for the deposit refund not to mention that fact that I was screwed out of a 15 yr note.
Some hard lessons learned with this deal.
