If you are IN TX, drop by your closest courthouse and with law librarian’s help, check VATCS (Vernon’s Annotated TX Civil Statutes) to see what citations you might find under L/O Statutes.

These can only be found in the annotated statutes, or an online subscription service such as Lexis, which could well be available to public at no cost at your closest courthouse.

I was reading about the bill HB1823 on lease options, but I haven’t found any information dated newer than 2005. Has it been repealed…any way around it? Any ideas? Anyone doing lease options in texas? Lease option only for 180 days? Lease options under 3 years exempt? Facts anyone?

This TX statute was overwhelmingly passed in 2005 and has completely changed lease/option practice in TX.

Basically TX Legislature has stamped out residential L/Os in TX.

Nowadays TX REIs are having to work in a different manner and with strategies other than L/Os, including use of Land Trusts.
