We need to do an eviction in Virginia, which is out of state for us. Anyone know a real estate attorney who handles landlord/tenant law who can advise us on this.

If you’ve done an eviction in Virigina (assuming the law is the same throughout all counties in the state), about how long does it take to get someone out? Ballpark … 7 days, 7 weeks, or 7 months?

Monique,

Va. law is simple. You need to fill out a 5-day “Quit Notice”. A pack costs $5 at Office Max. Keep the original, send the tenent 1 certified, 1 by rg. mail and 1 on the door.

Rent is due between the 1st and the 5th of the month.
Quit notices go out on the 5th at 5pm…close of business. 5 days usually stretches until the 12th…Sat, Sun and holiday excluded.
On the 13th, go to the court clerks office and pay
around $34 for a court date(unlawful detainer).

(Court date will be on average 20 days later).
You do not have to take their money after the 12th.
When you go to court and they show up ask for “possession”. Judge will give them 10 days
to leave and the judgement for you. If they do not show up…you get “immediate possession” and a judgement(writ of possession).

If they don’t leave you can get the Sherrif to schedule a date to “remove” their stuff. you have to pay people to
get it out. The Sherriff will just supervise and
watch you change the locks.
Hope this helps…we have not had to put anyones’ stuff out!!
