Well if its filled out wrong (Quit Claim Deed)…and worthless,I would assume I have nothing, other then the intent like I said. So…What I need is it to have been filled out correctly to stand up in Court…cuz this is where its going.

My Uncle Renegged on a Verbal agreement we had made in 1997. We took over payment of his Mortgage and taxes and have lived here for the last 7 years. We agreed at that time to pay him the value of the house(at that time) 14,000.00 in 10 yrs. This agreement was heard by my Father and my Husband as well as myself. A year later my Uncle came back to us wanted to take 10,000 cash call it even. We couldn’t afford to do it then. Now he has a Eviction Attorney and has said, he wants 1/2 of the Equity in the house.We were approved for a loan to have it changed into our names, in May 04 sent him the paper work, which he agreed to at the time. Now, he’s renegging…again. We have a quitclaim deed to show intent, that he had notrized in Shangi,China. We have had extensive upgrades to the outside and inside. What can I do??

Since you have a deed, if it’s been recorded, then obviously the notary’s acknowledgement was OK with the recorder, and the deed should be adequate proof of your ownership/title.

Suggest a cheap (free!) inquiry to a title co. in county of the RE to see if they think you have title…if so, what’s the problem?

If he signed a quit claim, (properly notarized) and transferred title to you, then it appears to me that you own the property. I would record the quit claim as soon as possible if you haven’t already done so.

I have the QuitClaim yes…but…It was filled out wrong so, it only shows my Uncles intent to sell.
