I agree with the last sentence. These situations are usually pretty sticky. However I find that if one spouse is willing to waive some money under the other ones nose, then that will open up the door for you to sell or refinance or whatever your plans are. He will show up to the title company (or attorneys office) because he will know he is getting a check!
Left my husband in a house we bought while he was unemployed; therefore,financing was obtained on my merit only. He is still not working. As of April 1,2006, he lives in the house, has not made a payment since April, owes over $3000 in back pay including a forced escrow for insurance that I stopped paying; meanwhile, his actions are not affecting his credit. He is affecting my credit. What can I do to get out of the mortgage loan, get him out of the house, and/or sell the property to salvage the little credit worthiness I have left?

Whatever you do, don’t stop making payment just to get back at him, because you will be hurting yourself more than him. Sell the house and pay off the mortgage. Keep your credit clean because it follows you where ever you go for 7-10 years.
Paying the mortgage only gives him another level of comfort. I cannot sell the house without his consent, or his signing off of the deed. So, even though I have put it on the market, should I find a buyer, there is no sale without his signature. How do I remedy this problem without waiting a year for the divorce? Pay his mortgage for a year along with my rental fees?
The other option is find an attorney to file a partission suit. It is expensive and time consuming. A judge will order the property sold and the proceeds divided. The split will be determined by the strength of your claim.
You could offer cash for a quit claim deed!
