I use a Month to month Lease and am going to terminate a lease with a renter of mine. Too many issues to shake a stick at and is why I use a month to month lease. The form I use is one you get at a office store. It states that either party must give a Full Month’s Notice. Question I have is I serve this notice this Monday 10/21/02. Does this mean I have until 11/21/02 or do I need to wait until the end of Nov. Other question is there is a chance once they receive this notice they will not pay Nov. Rent. The Rent is Due the 5th of every month. If it comes the the 6th. and they have not paid can I serve a 5 day notice or does the Termination notice stay in full effect? I hope this makes sense and after typing this out Maybe it belongs in the Real Estate law section. I live In IL. if that gives any ideas about my situation. Thanks for your help.
