When co-owners are tenants in common, the deceased’s share goes to
his estate. If co-owners are joint tenants, their is a right of
survivorshop, so that the other joint tenant inherits the deceased’s
share as a matter of law. The main importance of this the need (or lack
thereof) of having to deal with probate. If you are dealing with the
surviving spouse, you can simply get a deed from her/him so long as
the property was owned in joint tenancy and you have a death
certificate. If the property was owned as tenants in common, the
property must go through probate and the personal representative of
the estate must sign the deed. The Will of the decedent may even
name his surviving spouse, but the property still must go through
probate if the property was owned as TIC. The benefit of JT is that it
passes the property around probate.

Thank you for your reply. However that was not my question. In this case three children inherit the property. Does the real estate pass at time of death to the 3 children as “tenants in common”. What right of entry, access, etc.? live in house rights do these children have as tenants in common? Can one child lock out other children?

My domestic partner and i have property that was refinanced 3 years ago, when his name was put on the title. Prior to that, the home was solely under my name for 15 years. We are registered as joint tennants (50/50). We have signed a written letter letter stating that we are now joint tennants in common. What we invest, we get back. Can a letter we both signed agreeing to joint tennants in common still be valid, even though both our signatures are on that change from joint tennants to joint tennants in common
?

Tenants in common have the right to live in and enjoy the property.
They can’t lock each other out, unless there is a possessory agreement
among them.
