If you sell their property you could be in trouble. If it were me I would put their stuff in storage, replete with digital pictures. I would probably wait approx 2 weeks then I would continue or initiate as the case may be, the eviction process. It costs me $76.00 to file them and I do it all pro se. After receiving the writ, I would dispose of the stuff. I would not sell it even at an arms length transaction but that is just me.
My wife and I have had difficult tenants for the last year. These problems included late rent, no rent, eviction proceedings started (payment for 2 months then collected before eviction occurred), complaints from township for grass left unmowed, and currently, expiring lease with last 3 months of rent unpaid. The lease expires tonight at midnight, July 31st. It would seem the tenants vacated the property a week prior to the lease expiring and we have no forwarding address or information of where they went. In checking the property recently, they have left a considerable amount of property outside and inside the home. We would like to dispose of this property immediately so that we can re-rent the property. We are planning on entering the home tomorrow, August 1st and changing locks, cleaning/paiting, and disposing of the property to either the Salvation Army or the local landfill. We are also considering trying to sell some of the property to recoup some of our loss. They left items such as washer/dryer, refrigerator, two TV’s, etc… Can we do this at this time or is there some time frame to consider. It would appear they have abandoned the property. Any response would be appreciated.
