Thanks for the input! Not trying to get Animal Control to enforce a lease provision, but have talked to them & it is their job to take into custody any dog whose owner cannot show proof of rabies vaccination. It is not just a liability problem, but a safety issue. This is a rural county & this year both raccoons & foxes have rabies. (Up until this summer I fed both daily on my home property.) I just got rid of the pit bulls belonging to another tenant (very sorry to see him go, but there was no way to keep the dogs & it was his decision), & need to ensure that another potentially dangerous animal is not on my property. I am letting this tenant keep her original dog, though I w/not allow a replacement. Pretty sure if it wasn’t the extra dog issue that this tenant would find another situation to befuddle me. I have tried every which way I can to work w/this tenant, but it is clear she needs to have landlord issues. Her husband is hard-working & nice, & they have a new baby, so I’ve gone the extra mile, but I fear it is only a matter of a few weeks before she pushes one too many buttons or makes one too many hysterical phone calls.

Except for the village in which I live, this is a pickup truck, gun-toting, hunt-your-own dinner, big-dog-owning county. The influx of northerners began here because of the waterfront properties, but has expanded so that property values have shot up. There just isn’t much in the way of affordable housing, so am trying to do my part improving my MHP & still keeping prices reasonable. My job seems to be 50% social work these days–oops, just caught myself both venting & whining! Feel free to ignore me–

Got my pit bull-owning tenant to move (yeah!), but have one more dog owner giving me fits. When I bought my MHP I agreed to accept an existing nice dog owned by another tenant (my new signed rental agreement requires proof of inoculations, liability coverage, & obedience training). However, this tenant immediately got a 2nd dog & has ignored my (certified mail) deadline for removing new dog. Question: If a 2nd notice to remove the dog is given & ignored can I have the animal removed by animal control? (North Carolina) I’m virtually certain there are no vaccination records, so if I call animal control they WILL take the dog unless records are in hand. I am willing to evict if necessary, because (1) as a new owner I know I’m setting precedent, & (2) this tenant is a drama queen & is bound to be a continual nuisance. Any advice is welcome! TIA

Using Animal Control to enforce a lease provision will not work. If the dog is vicious, or is barking incessantly, you can use AC to remedy situation. But don’t expect AC to want to help you with a landlord-tenant issue.

give tenant a written demadn to get rid of dog within 24 hours. If tenatn fails to comply, file eviction papers the next day.
