Tax filing with SMLLC and EIN - Posted by tim
Posted by tim on February 21, 2004 at 08:17:30:
My wife and I file our income taxes jointly and intend to do so this year.
However, in 2003, I set up a SMLLC - disregarded entity (and got an EIN #) for asset protection of a rental that I will eventually do a 1031 exchange on.
Question: when filing, do I still put my name and social security #, and wifes name and social security # on the “1040”? Or does the EIN need to go on the 1040 next to my name, and then the wifes name would be listed with her social? does EIN or social go on the schedule C? help please. thanks
I set up a SMLLC (Disgregarded Entity) for the purpose of 1031 exchanging a rental property in the near future.

Your SSNs go on page 1 of the 1040. The EIN of your LLC will go on the Schedule C.

Tom,
One more question if I may. Will the LLC name or my name be listed on the Sched C along with the EIN? thanks again for your help.

You’ll put your name as the proprietor. There’s a line on the Schedule C to put a business name, if there is one. That’s where you’ll put the legal name of the LLC.
