the thought of having a pool in a rental makes my skin crawl. but here are some thoughts:

  1. make sure the pool in fenced, so that a little kid cannot get in. I have a pool at my house. My yard is fenced, which takes care of the outside world geting in. But I have little kids. So I had a temporary fence installed around the perimeter of the pool, as a second line of defense. a fenced pool is not an option. YOU MUST DO IT.

  2. Buy some general liability insurance for the property. it is usually not that expensive, but it is pricier when pools are involved. for good reason!! this is not an option. YOU MUST DO IT.

  3. Who pays for pool maintenance? My pool man comes once a wek, and charges me $100 per month. I owuld hate to be paying that bill for tenants. It hurts the bottom line, and that is what this is all about anyway.

  4. My Best Solution. If you really got a great deal, sell the place and rake in your profit. then go and buy another rental property sans pool. and you will sleep better.

I just bought a property that has a swimming pool. I really did not want the pool but the property was a great deal. I have two different prospective tennents that want to rent it because of the pool. I do have some time because sellers will move out next week. I have not committed myself with either one yet.
How can I protect myself with a lease over pool liability? Is there a release or disclaimer I could use for this? I am in Virginia if it maters.
