It is a long and deep story. I have seen this coming for a long time and have planned for it. I don’t know what goes into people’s heads that makes them think they can stay beyond lease-end and with a court-date already posted to the door, whatever.

I have to live in a hotel because the tenant living in my condo has not left. The tenant has a court date and seems clueless to what is really happening.
Am I able to sue for the costs of me (landlord) having to live in a hotel while I wait for their slackbutts to be hauled out of my place?
Dealmaker’s comment about suing in TX is correct. My tenants are low-income and have no assets to attach. and TX law prohibits wage garnishment. that is often the only recourse against low income slime.
HOWEVER …
a tenant who absolutely depends on Section 8 for all of most of the rent CAN BE SUED. I did it to a lady in Tyler. I got a $2500 judgment. She HAS to enter into a payment plan with me, and stick to it, or SHE LOSES HER VOUCHER. That voucher is a critically important asset to her and she will protect it at all costs. I get a $30 money order from her each month, and will get it for the next 15 years. and 10% interest, too.
At our little trial in the JP court, she brought her preacher and neighbors and aunts and cousins and children, all of whom attested to what a great person she was, how nicely she kept the apartment… Then I called my manager, presented some photos and invoices. the gavel slammed down. She protested : “He only suing me 'cause I’m a poor lady on Section 8. He don’t sue other tenants.” I smiled and replied" “You are absolutely correct on that one.” The judge added: “Welcome to the Real World, Honey,”
I admit, I can be a b@stard sometimes. But she left me 1300sf of garbage and trash and junk, destroyed a new carpet in 3 years, and trashed the interior walls.

I would only do so if I wanted to experience more time in court to no worthwhile end! Does the tenant have anything you can attach? In TX there is NOTHING that you can attach! That tends to color my thinking.
Not to sound cruel but it appears that your plan was to move right in the day they moved out?
