To whomever can help,

I had this broker who gave me the run around for 3 months without closing the deal. She told me i would have no money down on my 1st rehab deal, and the day of closing she told me i needed to bring money to the table. Once I arrived at closing, we also found out that she had not even sent all the required documents to the title company. Basically I did not close, and decided to tell her I no longer needed her services. In return, she says I still owe her money, and to top that off, she attempted to go behind my back and buy the property for herself!! Can you believe that? Now is there anything i can do as far as reporting her to someone that would effect her brokers license?

I passionately disagree with the recommendations you have received so far.

Notify the State Licensing commission of the facts and specific details (be brief but to the point) on both issues: (1) the failure to close based on their inability to function properly; and (2) their attempt to swindle the deal away from you.

Just the mere filing the complaint will put them on record…just in case someone else has the same sort of problem in the future.

For what it’s worth…sometimes you have to do things that don’t make you money but could save someone else the aggrevation you endured.

If she really did attempt to go around you and you can prove it, you can file a complaint with the state real estate commission. But before going to the trouble, ask yourself what it will accomplish. Will it bring you profit? Will it move you closer to your goals?

As for her saying you still owe her money, we can’t comment without knowing details here. But the bottom line is, the impetus is on her to collect, which is usually more expensive than it’s worth. Did you sign anything, like a buyer’s broker agreement?

It seems to me like you had a bad experience, and your best bet here is to go separate ways. If she harasses you, you could always keep the complaint in your back pocket. Your strategy there is to let her know that if she goes away, so will you, but without being overt about it (otherwise, it could be construed as extortion in arbitration, if it ever got that far). See how it gets complicated, quick? Is it worth it? I suggest moving on, in the most expeditious manner possible.
