A transfer return form is made out before deed is recorded. Each state is different, but similarities exist. There are a number of exemption codes that are used for circumstances when not a transfer-taxable event. Deeding to a trust for estate planning purposes is one of them. Get to know your transfer return form intimately.

Subject To and Transfer Tax - Posted by Bob (Ga)

In taking property in a subject to transaction (specifically in Ga) I am going to have the owner deed to a trust and have them assign their bennificial interest to me. My question: Here in Ga, what are the cost of doing this? Not necessarily the attorney fees (that is a given), but the court cost? Are there taxes due, and if so, how much?

Thanks
