If he had a business partner then the partner is liable for the arrestee’s obligations to you.

I hired a licensed/insured contractor who had the wrong shingles delivered to my rental property. (30 yr not the contracted 40 yr.) I paid him for the materials at his cost, plus labor when finished. He returned them and kept the money without re-ordering to correct shingles. After several calls I received a call back from his bus. partner who said he was arrested and in county jail on bad check charges. I asked about my $2500, he claimed it was on his posession. I wanted to stop him from using my money to settle the bad check charges. Is this a civil or a criminal offence? I thought since the materials were on site then removed, this could be theft. Any insight would be appreciated. I have a call into my attorney and a detective of the police dept. Thank you!
