He can quit claim the property to you, although if he is on the loan, it does not remove him from his debt liability. The only way he can be removed from the debt liability is to refinance the loan in just your name. When the closing takes place, he would have to quit claim his ownership at that time.

Long story short…ex and I still own a house together…up for sale…depressed area, so it’s not selling. He lives there now…but is moving. He no longer wants anything to do w/ the house. He wants to sign a quit claim deed to me. Is this possible if we still have a mortgage on the house? Do we have to contact the mortgage co. about this? Are there circumstances that this cannot be done under? We live in Maine. I know we should get a lawyer for this but we cannot afford one right now…can this be done by ourselves? Thanks
