It sounds like that agent was very gracious to you. She didn’t have to be.
The agent should have both the buyer and seller sign a release. It’s a standard form that she should have access to.

I found the house I wanted and was told by a relative that she would give me a gift of X,000 for a down payment. Well I bidded on the house and it was accepted. I signed the P&S agreement. In the Financing section of the P&S it stated that we would have to obtain a conventional mortgage loan, and to make every effort to obtain one. In the event that we would be unable to get the loan we need to advise the broker and seller in writing and agreement would be null and void and deposit would be given back to us. WELL!!! We began the mortgage process then got into a fight with relative and she refused to give the gift money. After failing to mend things with relative I notified the sellers agent. The agent stated that the check did bounce. The agent said that the house would go back on the market, and hoped to work with me next time. Should I be worried about any lawsuit by the agent for the down payment of X,000. Should I have sometime of release, waiver, or anything signed.
