My x and I agreed to a stipulation to sell the marital home with a named firm within 1 week, to be listed no more than X and no less than x. That took months to get signed. The divorce judgement dated months prior, stated if he wished to stay in the home he would have to refinance it or have it be sold. Also we are to cooperate with the broker and comply with their recommnedations, including sale price, repairs, showings etc to make good faith to sell property. My question is this: The signed agreement says that after 2 weeks the price would drop (as the original price was way over the fair market value.) He will not let the realtor lower the price as he says that it was not explained to him, even though he signed it and added to other items that made it that he be present for the showing and no signs are to be posted. Am I able to go to the owner of the company to enforce the listing agreement to lower the price? WIll they or can they drop my agreement? Is it likely? My concern is that the home is getting ready to go into forclosure for a 2nd time. The agents response to me was that he directed her not to, and they did not feel comfortable doing it unless we were both in agreement. I do not want them to drop me and go through the courts again to get it listed or fight him to sign another listing agreement. He has done eveything he could to sabotage the showing and potential sale of this house. The realtors still do not have a lockbox and he rarely responds to their emails or phone calls unless it has something to do with the price change. He has not allowed a weekend open house and wants scheduled showings only. I have no access to the home as I do not live there anymore, yet my credit is being ruined based on his lack of cooperation. Please advise.
