In Ohio you can try and buy the property from the owner up to the day of the sheriff sale. Sometimes the owners just move out and sometimes they don’t (free rent). After the judge gives the approval for the sheriff sale date to be set, the sheriff must advertise the sale of the auction for a minimum of 5 weeks. The owners may still be in the house. Some even stay after the sheriff sale. The winning bidder at the sheriff sale will have to evict after they take possession if the previous owner is still there. After the final bid at the sheriff sale it may take the judge 1-6 weeks to confirm the sale. Then the new owner takes ownership.

if there is a sheriffs auction in the legals section of the paper, does that mean the people are out of the house already and the process is passed the point of trying to pick it up as a preforeclosure? does the bank own it at that time?
