I have a rental with a fully fenced yard. The tenant always has the gate locked.

What is the legality of serving her a legal notice (in this case a 3-day notice). The law says I have to try to deliver to her personally twice at reasonable times before posting/mailing. Would staying outside the locked gate constitute an attempt to deliver?

I cannot find anything in the CA books.

I just am just trying to cross the Ts and dot the Is

Hi Gene. The eviction services I used in our area didn’t try to enter locked
gates or yards with dogs (or yards with people threatening to shoot
them). They recorded the times they went to the property for attempted
service, then posted on the gate or fence. I really don’t know what the
law says about it.

Thanks…that is pretty much my plan…I just wanted to bounce it off the group.

I am sure 99.9% of judges would think that is adequate.

Take a digital camera and get a couple of shots of the notice on the gate.

The DCs these days have the dates and times the pics were taken so there’s the proof to show the judge what you did, why you had to do it that way, etc.

Just take the DC to court with you and the judge can see the pics still in the DC.
