I have property in a land trust that already has a 1st mortgage on it. I wish to sell it by offering owner-financing to a new buyer, meaning that I’m willing to carry back a 2nd.
How do I set this up so that I am protected and without overtly triggering the due on sale clause? What instrument vehicle(s) is/are best suited to doing this? Contract of Sale? Recorded or unrecorded?
