Do you have an agent representing you? If so, they should be taking care of this.

If not, it’s up to you. Tell their agent that the seller is in default and that unless they live up to the terms of the contract you will void it and take your deposit back. Then be prepared to do so if they don’t comply!

I have a flood damaged REO (a rehab with extensive renovation needed) under contract - I’m dealing with an agent representing the bank who owns the property. I have 10 days to get the property inspected - but the seller’s agent refuses to turn the water on for a plumbing inspection. There are no sinks (but there are shut off valves) and they’re concerned that the property will be damaged more if the water is turned on (the city has it shut off currently). They want me to sign an agreement taking full responsibility for any damage that may occur if the water is turned on for my inspection. The contract reads:
“Buyer may have the property inspected by inspectors permitted by law to make inspections. Seller shall permit access to the property at reasonable times for (1) inspections (2) repairs (3) treatments and (4) reinspections. Seller shall pay for turning on utilities for inspections and reinspections.”
Is this blatant breach of contract or what? It says I can perform inspections as needed and that they’re liable to get things turned on - but they say they won’t do it. Anyone been in this situation before? Any thoughts on this would be appreciated.
