When getting the deed from a seller and he is willing to take back a second, how do you do that! I mean what documentation is involved. How do you handle this if your at the sellers kitcnen table ready to close the deal? By the way I live in California.

Hi Rick, you need Grand Deed for transferring title, a note for the second and Deed of Trust to secure the note to the property. Hope this helps. -whyK

Get a title company to provide the documents. Tell the escrow officer what you want and then read the closing documents to verify that they say what you wanted. If you don’t understand them, give them to another lawyer to see if they comply with your wishes.

Experienced real estate lawyers don’t charge excessive fees for routine review; probably less than the earnest money you’d lose, or the legal defense you would have to mount if things are screwed up. They?ll come up with a few things to justify their fee, but that?s O.K.

In the past, I was really into contract law. Good attorneys kept me from shooting myself in the foot plenty of times. Use professionals if you want a professional job done. Again: pre-emptive law.
