This is common especially in Texas. Mineral rights, Water rights, Hunting rights, and even air rights are often sold seperatly. Very few property owners own minerial rights there. Consult an attorney. It unfortunatly sounds correct if they can document the deed.

A gas company recently came to our family with a deed showing they owned the mineral rights to our property which was prevoiusly unknown to us. The land granted to our family in 1840, a land dispute in 1891 which resulted in my great grandfather signing away the mineral rights to retain posession of the land. This happened to several “farmers” in the area. Is this an illegal posession, a legal real estate contract?
