I have a tenant that breached our yearly lease by leaving early, in addition to leaving a considerable amount of property damage that combined totaled $5800. I filed a small claims case for the maximum $2000 allowed.
She hired an attorney that stated I violated security deposit statue and lost. Now they are appealing before a jury of six. I did deposit the tenants $1000 security in a secured interest bearing account. However, the tenant would deposit the due rent in same account. I would then transfer the rent portion ONLY into my private account. My understanding of the security deposit statue was that the purpose of the secured account was so that my creditors could not get to tenants security money. Have I broken the law by above circumstances?
