I am interested in purchasing a note from a private note holder. The payor on the note has a small judgement against him that was filed after he purchased the house securing the note. The note is the 1st, the judgement would be the 2nd.
Can I purchase that note and restructure it without losing the 1st position ? Or will the judgement take 1st position once the note has been modified.
