They waived inspection, but did you disclose the things you did know: bowing walls (not good), patched up walls and so on? If not and you knew about it, you could have a problem (I assume you have good liability insurance). If you did disclose and they still waived inspection, then you’re probably safe.
I had a homeowner that purchased one of my homes about 6 months ago call me and ask why I hadn’t responded to her attorney. I haven’t received any correspondence from any attorney whatsoever. She waved her inspection when she bought the home. Now she is claiming that the basement flooded 3 inches deep from a foundation problem and wants me to pay 20K to fix it. The basement was your typical wet seeping basement when we bought it but it sure as heck didn’t flood. There was an obvious bowing in one of the walls and two other walls has been repaired in the past by doubling up the block. I had the grading all the way around the home fixed and new gutters installed and it stayed dry in all but the longest of downpours. And even in a heavy rain it would only seep in one or two areas. It was VERY minimal. Kick a towel across it and you were done. I have never had any legal issues associated with one of our homes. What should I do? Does she have a case for remediation? The disclosure sheet didn’t list any moisture problem in the basement. Am I screwed because of that?
