What does this mean? How do you get her off mtg note?

No way in the world can she or you do anything to get her off the mtg other than to pay off the lender. Her lawyer should know that and tell her so.

But if you sell it to some good 3d party buyer who’ll give you a RE contract, and pay you more, with a monthly payment of more than you & ex-wife’s payment to that lender, you can just continue to pay that mtg payment each month until the loan is paid off.

If I sign any note to anybody, I’m going to be on that note until it’s paid and no other way to get “off the mtg”.

Just wondering if Quit-claim deed would be the easiest for my parents to transfer an investment home to me? I have occupied this house for the past few years and they’d rather do this and take back a personal note due on settlement of their estate rather than sell it to me. House is owned outright by them with no mortgage. Any thoughts on tax or gift issues also? Thanks in advance and great work CREOnline!

I’d spend a few bucks and get prelim title op from a local title co., and that’ll tell you who’s on title now, then get QCD from said named person(s)and that should be all you need.

IF those persons (parents) are provably competent when signing…and it’s my practice to prime the notary public whenever getting any conveyance doc from a Sr, to ask some few questions so as to establish in the NP’s mind that the person is/was very competent and with-it whenever he/she did sign.

I have a question I am getting a divorce and my ex wife soon to be is on the old mortgage and she quick deed the home to me how do I get her to sign off mortgage to me cause we are in CH13 but I cant refinance it in my name if she dont sign off
