If that’s so, then they surely WILL record so their mortgage will appear on the records, and to pretend it doesn’t exist is to invite trouble…and it’d be fraud to state that it’s non-existent.

What’s a mortgage co protection if they forgot to record new mortgage on a re-fi and the property is in preforeclosure and the seller wants to walk and deeds the property to me, on record is orig mortgage with no release?Also at time of re-fi, deed was quitclaimed from two parties to one and that was not recorded either? If I had both parties deed me the property and I get a release from orig Mortgage on record, did I just get this house for FREE?
