Every state is a bit different but in general I would say you can enter. this is not legal advice…

As to left over personal effect, the same applies. Most states require to you value it at some figure per your state statutes.

Then you must hold it , normally in a U-Rent type of facility and dispose of it in an “Arms Length”. In other words, you cannot just dump it or give it away because he stiffed you. Until you comply with your state statutes…it is his property and he can sue for recovery.

Also it is a sjmply matter to go to the U-Haul dealer, show him your judgment, tell him your tenant…Mr XXXXXXX skipped owing you money and left personal items on your property, in one of his vehicles and you would appreciate knowing where the vehicle was bound for.

This happened in Utah. Landlord started eviction. Tenant stalled and made promise to pay. Tenant did not pay after 1st installment of payment. Landlord drove by and tenant was in the process of moving with U-hall truck in front of property. Tenant refused to provide future address (said did not remember address but knew how to get there). Landlord went forward with judgment and received money judgment.

Landlord drove by to take possession of property. Tenant left substantial amount of property in the garage and in the yard, apparently on purpose.

Can we enter? What is the right way of taking possession of property?

Any advice will be appreciated.
