real estate laws - Posted by Janice Schmidt
Posted by Janice Schmidt on October 29, 2004 at 12:58:46:
I live in Minnesota and have been informed that the law in Minnesota requires that I have my husband’s signature in order to sell the house that we are living in even though the deed to the house is only in my name and was purchased with money which I had before marriage. Does this law pertain only to one’s main residence or does it also include a second home? Does this law also include property which is used as rental property? I realize that you may not know this answer without research and if so, where would I go to find the laws in Minnesota regarding this without needing to pay a lawyer to find out the law for me? Thank you in advance for your help.

Check with the title company you used to purchase the property. They know the laws required to transfer property.
The info you get is free from the title company.

The title company won’t help me or answer my questions, that is why I am here. This is in regard to other property that I am considering purchasing in the future and the property which I purchased was 5 years ago and they won’t help me now. If you know of a title company which will answer my questions, please let me know, but noone will answer a general question like this. They all say that they do not give legal advice. I would like to know if laws require my husband’s signature even if the deed is only in my name and what type of properties this would relate to. Where do I go to find out the Minnesota laws on this? Thank you for your help.
