Yes its legal, but the type of entity will change the tax ramifications of the deal for you. You will need to do your homework if you want to accomplish certain tax benefits.

I am considering starting a real estate holding company to
invest in residential real estate. Does anyone know if it
is legal for the owner/co-owner of the company to live in
the property as his/her primary residence? What about if
the owner is making improvements to the property while
living there?
