I tried to buy a lot back in 8/18/03, but the saler’s had a title issue that they needed to clear up. They baught the property with a quick claim deed. The saler’s draged there feet for almost one year before they hired an attorney to look into the problem. The attorney said that they were victoms of fraud. At this time 6/10/04 my realtor said that she was backing out from the sale /buy of this property, she was both mine and the salers realtor. I told her that I do not want to end this escrow, but she left any way. Well to make a long story short I just found out that the salers clear there title problem on 1/19/05 now I feel like I was the victom of fraud. My escrow is still open, but the salers say they dont want to sale to me. What can I do?

What does your contract say regarding the settlement date and what happens then that date is not met?

You don’t give enough detail. But if you really do have an active contract I would sue the sellers for specific performance (you don’t indicate if it’s worth it).

You say the agent was representing the both of you, or was she really representing the seller and you were a prospective buyer? In any case include her and her broker in the lawsuit, she may have become your agent too, due to things she said and her conduct during the transaction, if that is the law in your state.

If there isn’t much to be gained, then forget it and consider it educational, and spend your time finding a profitable deal to work on.

It annoys me when people, usually uneducated women, overstate their case by accusing the other party of some dishonest motivation. I wouldn’t want to sell to you either.
