I found out the tenants in my condo are illegal and the wife has had a baby, they have lived there for 4 months and they are always late in paying there rent and have not payed there electric this month, the question if I call immergration am I liable seeing as she has had a baby in this country recently or will they take them out of my condo,

Your post doesn’t mention it, but does your lease require that the utilities are to be in the tenant’s name? If so you can evict for that reason. If not, you should still be able to evict because the non-payment of utilities is still non-payment.

You shouldn’t be liable for knowing they are illegal if you didn’t know when they moved in. But it’s clear that it’s time to force your hand because if you know and do nothing you could be liable. They have a lot more to lose than you do. I’d probably verbally tell them that if they don’t move out, in so many words certain officials would be notified. Being broke in the US is still probably a better option than going back to Mexico so they’ll more than likely leave. I’d also negotiate the deposit return because they can trash alot more than it will cover. They may be less inclined to do so if there’s a chance they can get their money back. (less utilities of course)

Of course if they get deported who will be there to ask for the deposit back?

If it were me, I’d find a way to get them out without getting the government involved - even if it meant paying them to leave. Could be much cheaper. The real risk here is inaction by Immigration. In many places, they don’t seem too interested in picking people up unless they can get at least 15 at a time.

Why don’t you just serve them notice when rent is not received and follow through with eviction? You’ll need to check your local laws since they may be allow to cure their default a certain amount of times before you can evict them.

Thank you for your responce, I served them a 3 day notice to quite but they paid there rent but not there electric which is in my name, and they just had a baby here in the USA, the question is can I turn off the electric seeing as they have paid in the rent for January?

I’m not an attorney. I would never turn off someone’s electricity regardless of what the lease says. You really need to check with an eviction service or atty in your area to find out your options. It’s possible that you don’t have to accept the late rent next time.
