Let me preface this by saying that I am not an attorney. This is my personal opinion.
Did you offer the listing price of the home or did you make an offer that was below the listing price? It is my understanding that if you offer the listing price, the sellers are obligated to accept that offer. Although, if there is more than one offer for the listing price, then, I believe there may be a whole new ball game.
If you offered less than the listing price, then the sellers have a right to refuse the offer.
Property OFFER involving DIVORCE - Posted by Patty Mai

We made an offer on a home. We were told we had the highest offer out of many on the property, then our new agent (also works with listing agent) told us that our offer needed to be approved by the court because the sellers are going through a divorce. Our offer had not been accepted, but the house was put on hold. It has been about 3 weeks and when we called our agent to finally see what was going on, he now says the house has been put back on the market as active and the divorce lawyers would like to see what other offers come in. Our agent tells us if higher offers come in, that these tedious legalities will probably keep them getting the house and that we are still in the top spot to get the home. I feel like we are being pushed around. Is all of this legal? And if so, is our agent working for our best interests or the sellers?
