property lines - Posted by CHERI SADLER
Posted by CHERI SADLER on October 27, 2007 at 14:29:42:
Hi I bought comerical property and ran a business for six years. It also had a house on it and we sold it to my in laws. Four years later we sold the business, as my in laws were thinking of selling she had a survey done and found out half her house was on the business side. When I sold the business I told them where the property lines were and also told my realator. Now my in laws want us to sue for the rights to her property, We do have a lawyer but should we have to be the ones to sue and could he counter sue for not getting a survey and mis informing him. I truely believed what I told him was accurte, Thank you

Unless you’ve been damaged plenty and monetarily then I’d wait until you’ve been sued to respond or litigate.
Actually you have no suit until you have been damaged by another so what would/could you sue for now?
Since most threatened lawsuits never materialize this one probably won’t either and waiting might just make it evaporate…other side doesn’t want to spend money for attorney fees either and might not ever do it.

Thank you but my mother in law wants her house on her property, right now half of it is on the other parties property. She wants me to sue for her property rights.

I don’t think you have standing to sue anyone–you have sold the house and the biz, right? I think your mother-in-law might have suit against you. Eventually, she may have an adverse possession claim against the business. Call your attorney.
