In 1997 I bought a house from the woman who lives nextdoor to me. The property was purchased with the understanding that the property line between her place and mine was marked by antiquated cedar posts, a rock wall and a huge line of lilac bushes, all in line with each other. In 2002 she has her property surveyed and claims that she actually owns 18" past those posts, into our existing yard. She is demanding that I move my fence. My fence has been in its current location for more than 10 years, and the cedar posts that it’s attached to have been here since the 1950’s. Can she force me to move this fence, or did she commit fraud in selling me this property, by having the legal discription changed 4 years after the sale?
I apologize for the length of the question, but I am looking to hire an attorney if I need to. I really need to know what I am up against. Incidentally, the rest of the properties on the street would need to be adjusted to accommodate this 2002 survey. They all have fence line that would need to be moved.
