His price really is not the best if he doesn’t finish the job. I went through this a few years ago in relation to the builder not wanting to do any of the repairs under the home warranty. Got a lawyer…and she was even able to collect 80% of her fees in the suit.

I have just found that the builder of my new home has a reputation of not wanting to finish items on homes and also just not doing specific items that are in the contract such as taping and texturing the walls of an interior wash room,etc. He sometimes barely escapes code violtions, but does comply when pushed.

question: when problems start with my construction, (now in form of basement wall phase), what leverage do I have. In the past the builder has gotten to the end of construction then simply told the buyer’s they are released from the contract , then sold the homes for more to a new buyer. I am aware of the clause in the real estate contract for 10% due to me if he screws up, but really his price for the sq. footage is the best around, so I want to find a way to hold him to the contract.

Help!

Don’t judge your builder on rumors you heard from someone else. Judge them on the performance they do on the construction of your residence.

If you have concerns, voice them to your sales agent. If after the closing you cannot get the builder to respond to the things that need to be fixed, file a claim with the Better Business Bureau in your area. Builders do not like this and will usually do whatever it takes to maintain a satisfactory rating with the BBB.

Make sure that your needed repairs after closing are expressed to the builder in writing. Keep good records that includes all phone calls, letters sent, etc. The BBB will need copies of these.
