I have been working a probate deal for a few weeks now. The Arv of the house is 140k, repairs are 5 - 7k, buying for 79k. The assigned personal rep that agreed to sell for 79k is saying she is going to withdraw because the single heir is being too difficult to deal with, and not helping by providing needed info (she is a pain in the arse for sure). The other reason is because she is not sure their will be enough money in the estate to pay the attorney and her fees. No house payment has been paid since 12/05. If she withdraws would the bank foreclose or would they likely hire a probate attorney to finish that off. I plan to offer to pay the attorney fees if needed to keep the personal rep. Any other suggestions?
