I’m not sure about Florida Laws, but there shouldn’t be anything wrong about mailing to homeowners. Maybe check with the U.S. Postal laws?

Pre NOD Mailing List Question… - Posted by Steve

I’m getting ready to do my first yellow letter campaign to 60 day Pre NOD’s. I’m an investor, not a licensed broker or lender. The mailing house I’m using is asking for my broker/lender # and claims that’s the only way I can get the list? I know there’s ton’s of investors using these lists without being licensed.
Does anyone know if this is the law? If so, how are non-licensed investors getting the lists? I saw a site that sells the list to anyone, but of course they’re double the price.

Either clear up the issue with the mailing house or find a new mailing house.

What “list” are you speaking about? I know in California that a new rule went into place on July 1st. It says that you must display your broker/agent license on your advertising pieces, websites, etc. But you are not listing homes, you are just marketing to NOD’s. Maybe’s there a way to tell the mailing house that you are not selling homes, just marketing.

You may be on to something. I’m acting as a private individual wanting to buy a house from a private individual…not list or sell.
As for the “list” I’m referencing - 60 day pre notice of default. I’m in Florida.
