thank you for the reply. i have a motivated seller, and the house has been listed for about 6 months, so i was planning on talking to the owner, but can i talk to the owner or do i have to talk to the agent first?

You can talk with whoever you want, but be aware that the seller signed a listing agreement with the agent and may be liable to pay that agent whether you go through the agent or not.

Why not just contact the listing agent and make your offer?

There’s a difference of opinion here on the board on whether it’s worth it to go after properties listed by an agent. Some think that since they’re listed, that you can’t get a good deal because everyone knows about them. Others on the board make a nice living buying properties listed by an agent. You have to find out what works in your area.

But, to answer your original question, if it’s listed, you should try going through the agent, and if they’re not cooperative, then go straight to the owner.
