Due to a subdivision, I have a 50 foot easement for ingress, regress, and egress on my neighbors flag lot property that is in his deed and my deed. This neighbor refuses to properly maintain the driveway. He had fixed the part of the driveway that does not have the easement. Problem is, I would place stone on the driveway, however, he has destroyed the driveway with his snow plow in the winter, including the part that he did fix. It is in a dangerous condition at this point. If I invest in stones necessary to fix the driveway, I know that he will destroy the driveway with his snow plow and I would be in the same situation and out of the money. I would like to take him to small claims court to sue him for the repair expense as the driveway is dangerous and is limiting and restricting access to my property. Is this possible? I live in Bucks County, Pennsylvania. I did contact the township and they want no parts of it. Thanks.
