Ronald,

Thanks for the comments and concerns. You’re advice,
as always, is priceless. I don’t mean for someone to
take it out of context or misconstrued at all. I am
not talking about experience; I have never had a pro-
blem with advertising and someone calling me on the car-
pet for not being exact in it. It is something that
definately needs to be looked into though.

Thanks, you could have saved me millions (or something like that).

Respectfully submitted to the ‘priceless one’,

I have seen this advertisement in the local paper:

We can help you sell your house!
NO COMMISIONS!

When I call the number it turns out to be an investor working the market from the option angle.

The concern that I have about this is:

-Is it not illegal to advertise in the newspaper to be able to sell someone’s house and NOT be a LICENSED REAL ESTATE AGENT?

I understand to some degree how the option side of the market works.

Wouldn’t IT be better to say:

Need help selling your house
call ###-####
NO COMMISIONS!

That way no one can ever say you were trying to advertise as a LICENSED REAL ESTATE AGENT.

Thank you.

I don’t think it really matters. Which way is better
selling the ads? I’d use the one that works best and
it seems that it motivated you to call…based on the
old commercial thoughts: ‘The stupider it looks,
sounds, acts, the more they remember it’. Super Bowl
Sunday will showcase lots more comercials like that.
You remember the stupid ones…ok, maybe I’m
stretching, but you see the point. Anyone can sell
anything as long as it doesn’t infringe upon the one
selling. I could sell your car for you and make $1000
more in the deal than you did…and all I’m saying
is form the right corporation and the law takes care
of itself. After 10 car sales don’t you become a
dealership in the sight of the IRS? Anyway, if you
made it through ALL that and got NOTHING out of it,

TAKE THIS: “I was recently on a tour of Latin America, and the only regret I have was that I didn’t study Latin harder in school so I could converse with those people.”

I think Mark raises a legitimate question. You say: “Anyone can sell anything as long as it doesn’t infringe upon the one selling. I could sell your car for you and make $1000 more in the deal than you did…and all I’m saying is form the right corporation and the law takes care of itself.”

Are you an attorney? Or have you had attorneys tell you that this is the way the law works?

I’m not an attorney, but I doubt very much that what you have said is correct. DO you have something to back up what you are saying?

Remember, not only Mark is reading this. Whether Mark is harmed or not by relying on your statement, somebody else may be.

I guess you are trying to be helpful. But if you do not have good sources for your advice, I’d suggest that you might want to think twice before giving it. Or perhaps make sure that you say it in a way that would not be misconstrued by the beginners.
