“is there anything I can do”…Yes, take this to your lawyer. There’s too much to your contract that I can’t see, and wouldn’t take the time to scrutinize on a public board like this even if it were all there…so your problem needs to be tended to by your private lawyer.
Several issues involved here, pertaining to question of whether you really have a binding contract with seller or not.
Sounds to me like NO you don’t, if his attorney is willing to disregard your agreement and proceed with another prospective buyer.
But you just need to pay a pro to go over the paperwork, for you, and then tell you what you have and what your rights are.
We currently have an offer on a house, the owner is dealing with an attorney and short pay to the banks, not sure of all the details. me and another person have placed offers on the house signed off by the owner. I guess it has to go to the attorney to be ok’d. Aug 28 we were told by the real estate company that no other offers will be taken, and ours is the highest and best offer. Now I am being told that the attorney might have someone to buy it for cash. We are already approved for the loan. Can other people come in and can the attorney override our offers for this other buyer? Is there anything I can do we have been waiting so long and really want this house.
