Since the notary is attesting that the signatures are in fact those of whom they are purported to be, it is typically required that the document be signed in front of the notary.

Notary - Do we need to sign in their presence? - Posted by Erin

I want to sign a contract with a money partner, but was wondering if we need to do it in front of the Notary or can I take them the signed docs and have the Notary do his/her thing.
Thanks.

I’d recommend that you both go before the notary. Once I had a notary make a house call to get a deed notarized on the spot. Months later the seller claimed that they never notarized the deed. Convienient Youth Altzheiners, or CYA as we like to call it. Be safe or you could be sorry.

Maybe the contract with your partner could be executed in counterparts and each part notarized separately.

Well, since the part the notary fills in says “Sworn to or affirmed and signed before me” …
