MLS has nothing to do with it. MLS is a marketing service that a real estate broker may or may not be part of. Locally you will find commissions will run about the same from one office to another, however reducing a commission is not illegal. So negotiate before signing a listing contract. Flat fee services are legal if negotiated.

Price fixing is NOT legal. For all brokers to charge the same fee could very well be considered price fixing.

There being NO cap or max or bottom on RE commissions, this being a free country, whatever the parties agree to in writing.

Just remember that all RECs are owned by the Broker so he/she should be consulted as it’s going to be his/her decision here that matters.
