You’ll need to know the laws pertaining to adverse possesion in your state. An attorney would probably give you better guidance as to how the circumstances may affect the outcome.

Generally, if it’s a feet over for a number of years as stipulated by state law, (it’s ten years in NY State), you raised no objection (did anyone write him a letter?), you might be out of luck).

I was told by by next door neighbor my fence is several feet into her property, and learned of it when she sold, when the buyer got a survey done. But my fence was on that spot for nearly 20 years, so the new owner is out of luck.

My next door neighbor passed away about a year ago. The House is now up for sale. His Garage was over onto my property by a few feet. He was a sweet old man and always helped my husband with the lawn and every little task my husband came up with. We never made him tear his garage down and move it back. Now that the house is up for sale. I need to know what my legal rights are.
