Interesting solution, but not one I would recommend. Careful here you may get more than you bargined for.

NEED HELP!! WE ARE NO LONGER TOGETHER - Posted by bobby

My girlfriend and I purchased a home approximately 8 years ago. We broke up after living in the house for 3 years. I have been paying the loan and taxes on the home without any support from her. I now would like to sell the home but she is ignoring my emails and phone calls. I have sent a certified letter to her last known address but it was returned. What can I do?
Partition action - Posted by John Merchant

The law has a remedy for this, called a partition action, or PA for short.
You’d file the PA suit, then go to court and ask the judge to enter an order giving you or a neutral 3d party title so you could sell, then divide the proceeds equitably, where she’s paying what she owes on PITI before getting any part of sales proceeds.
W/O a lawyer you could file on your own, “pro se” after finding the form for such a lawsuit in your local law library’s form books which the L Librarian could show you in minutes.
It’d be you as the plaintiff and her as the defendant whom you’d have to serve with the suit papers as required by your state law…look under “process service” in your statutes and you’ll see what your law requires, then make a visit to one of the pro service agencies that office near your courthouse and make a deal for them to serve her.
A local Title/Escrow co could help you find a case and court file you could copy where this has been done by somebody else so you don’t have to re-invent the PA wheel.

Find a notary who will meet you in a dark alley some night to notarize your “ex-girlfriend’s signature” granting her interest in the house to the buyer.
Might cost you a couple hundred or so.
That will teach the little b*tch to ignore your e-mails and phone calls.

Did you/she remain in the house? Did you lease it? You may have to bring a partition action to force a sale. How much is the home worth? how much is the mortgage? How much are market rents (for a similar property). Depending on the facts you may be able to demand that she pay a portion of the taxes and mortgage–you can recover from the proceeds of the sale.
