Not sure what you are talking about here. Generally, lis pendens can only be recorded when a law suit is filed that affects title to property. It is a mechanism by which to provide record notice that there is a dispute over a piece of property. A creditor cannot run out and record a lis pendens just because payments are late. There are other remedies for that such as jugement liens and forclosure.
I’ve been chasing lis pendens like everyone else. Is there anyway of finding out if some one is late on payments before a lis pendens is issued? in order to lighten to competion?
One way to get a little head start on this is to prepare “Facing Foreclosure? I can help” business cards and distribute them to mortgage lenders and brokers. Tell the broker, “I know you can’t divulge names to ME, but if someone comes in behind in their payments, please give them my card.” (Many folks go to mortgage brokers to try to refinance when they get into trouble. Of course, the brokers can’t/won’t help them at that point since they are terrible risks. But they could hand out our cards… )
